AGREEMENTS/CONTRACTS

10. APPLICATION FOR DRIVER EDUCATION ENHANCEMENT FUNDS
Description

Pursuant to Section 318.1215, Florida Statutes and Section 122-35 of the Sarasota County Code, a $5.00 surcharge has been added to each civil traffic penalty in Sarasota County to enhance the funding of driver education programs in public and nonpublic schools located in Sarasota County.  The funds are restricted to the enhancement of driver education programs and are to be used for direct educational expenses only.  Only driver education programs that require a minimum of 30 percent of a student's time spent in "behind-the-wheel" training are eligible to receive the funds.



Recommendation

That the Board approve the application for Driver Enhancement Funds.

11. AGREEMENT FOR THERAPY SERVICES BETWEEN THE SCHOOL BOARD OF SARASOTA COUNTY AND INVO HEALTHCARE ASSOCIATES, INC.
Description
The school district has contracted for occupational therapy, physical therapy and speech therapy services since there is a shortage of staff available for direct hire.  Funding is via FTE generation.

Recommendation
That the agreement for therapy services between the School Board of Sarasota County and Invo Healthcare Associates, Inc. in the amount of $140,000, be approved as presented.

Description
This agreement between the Patterson Foundation and the School Board of Sarasota County, Florida, provides last resort, one-time, urgent funding for students to prepare and equip them for positive classroom performance.

39. APPROVAL TO TERMINATE THE CONTRACT BETWEEN THE SCHOOL BOARD OF SARASOTA COUNTY, FLORIDA AND CHILDREN'S HAVEN AND ADULT COMMUNITY SERVICES, INC. D/B/A SELBY PRESCHOOL DATED JULY 19, 2011
Description
The contract gives either party the right to terminate the contract, without cause upon thirty days written notice.  The Superintendent sent such notice dated July 21, 2011.

Recommendation
That the School Board approve and ratify the Superintendent of Schools action of July 21, 2011, terminating the School Board's contract with Children's Haven and Adult Community Services, Inc. d/b/a Selby Preschool dated July 19, 2011.

EXPULSIONS

40. APPROVAL OF EXPULSION CASE NO. 11-287
Description
The student listed in Expulsion Case No. 11-287, is in violation of an accepted Expulsion Settlement Agreement for alternative school placement. On December 3, 2010, the student listed in Expulsion Case No. 11-287, violated School Board Policy 5.34(1)(g), Severe/Repetitive Inappropriate Activity. It is the recommendation of the Superintendent that the student be expelled from the Sarasota County Schools until February 17, 2012.

Recommendation
That in accordance with provisions of Sections 1006.07(1)(a)(b), Florida Statutes and School Board Policy 5.34, the holding of a hearing having been waived by the student/parent, the recommendation as specified in Expulsion Case No. 11-287, to expel the student referenced therein from the Sarasota County Schools, be approved effective immediately until February 17 of the 2011-2012 academic year.

41. APPROVAL OF EXPULSION CASE NO. 11-525
Description
On June 6, 2011, the student listed in Expulsion Case No. 11-525, violated School Board Policy 5.34(1)(d), Battery on Another Student. It is the recommendation of the Superintendent that the student be expelled from the Sarasota County Schools until June 4, 2012.

Recommendation
That in accordance with provisions of Sections 1006.07(1)(a)(b) Florida Statutes and School Board Policy 5.34, and the holding of a hearing having been waived by the student/parent, the recommendation as specified in Expulsion Case No. 11-525, to expel the student referenced therein from the Sarasota County Schools, be approved effective immediately for the remainder of the 2011-2012 academic year.

Description
On December 2, 2010, the student listed in Expulsion Case No. 11-213, violated School Board Policy 5.34(1)(a), Possession of Substance Capable of Modifying Mood or Behavior. It is the recommendation of the Superintendent that the student be expelled from the Sarasota County Schools until August 1, 2012.

Recommendation
That in accordance with provisions of Sections 1006.07(1)(a)(b), Florida Statutes and School Board Policy 5.34, and the holding of a hearing having been waived by student/parent, the recommendation as specified in Expulsion Case No. 11-213, to expel the student referenced therein from the Sarasota County Schools, be approved effective immediately for the remainder of the 2011-2012 academic year.

43. APPROVAL OF EXPULSION CASE NO. 11-480
Description
School Board Policy 5.34(4), permits the Board to hold in abeyance the expulsion of a student if the student participates in a recognized alternative-to-expulsion program. This student is being placed on a Deferred Expulsion at Riverview High School.

44. APPROVAL TO AWARD BID #12-0129 FOR PETROLEUM PRODUCTS
Description
Bids to provide 'Petroleum Products' were received from four vendors on June 23, 2011.  The bids of J.H. Williams Oil Company, Inc., Palmdale Oil Company, Port Consolidated, and SSI Petroleum were the best low bids meeting the advertised specifications.  Reasons for not selecting the apparent low bid are included with the bid tabulation.  This bid is for one year with the option to renew for two additional one-year periods.  The funds for these purchases are contained in the operating budget allocated to the Transportation Department.

Recommendation
That the bids of J.H. Williams Oil Company, Inc., Palmdale Oil Company, Port Consolidated, and SSI Petroleum, to provide 'Petroleum Products' in an amount not to exceed $100,000, be approved for award and purchase.

45. APPROVAL TO AWARD BID #12-0130 FOR HVAC FILTER REPLACEMENT
Description
Bids to provide 'HVAC Filter Replacement' were received from four vendors on June 29, 2011.  The bid of Kleen Air Research was the best low bid meeting the advertised specifications.  This bid is for a period of one year with the option to renew for two additional one-year periods.  Funds for these purchases are contained in the transfer from capital budget allocated to the Facilities Services Department.

46. APPROVAL TO REJECT BID #12-0134 FOR BREAD PRODUCTS
Description
Bids to provide 'Bread Products' were received from two vendors on July 7, 2011.  The bids of Flowers Baking Company of Bradenton, LLC, and IBC Sales Corporation were non-responsive to the product specifications.  It is requested that both bids be rejected.

Recommendation
That the bids of Flowers Baking Company of Bradenton, LLC, and IBC Sales Corporation, to provide 'Bread Products', be rejected.

47. APPROVAL OF THE 2010-11 DATA COLLECTION REVIEW COMMITTEE REPORT
Description
In accordance with Florida Statute 1008.385, the report of the activities of the Data Collection Review Committee is presented.  The goal of the committee is to review and approve all district forms and achieve standardization.

CONSTRUCTION

48. ACCEPTANCE OF CONSTRUCTION SERVICES' PROJECT COMPLETION AND APPROVAL OF FINAL PAYMENT TO CONTRACTOR FOR THE BOOKER HIGH SCHOOL REBUILD: PHASE 1.A PORTABLE CAMPUS PROJECT
Description
All work has been completed and all required close-out documents have been received from the contractor.  The final project costs have been internally audited and are enclosed herein in Change Order #1 for approval.  The Director of Construction Services has determined that the project is complete in accordance with state statutes.

Recommendation
That the project be accepted as complete and the final payment to contractor be approved as presented.

49. ACCEPTANCE OF GUARANTEED MAXIMUM PRICE PROPOSAL AND APPROVAL OF CONTRACT FOR CONSTRUCTION FOR PHASE II OF THE SARASOTA MIDDLE SCHOOL-HVAC RENOVATION PROJECT
Description
Under the terms of the 2/1/11 (Item #28) Board approved "Agreement between Owner and Construction Manager for Pre-Construction & Bidding Services", the Director of Construction Services and a member of the Professional Services Selection Committee (PSSC) have successfully negotiated a contract with Jon F. Swift, Inc. for Phase II of the Sarasota Middle School - HVAC Renovation project.  As indicated, the 2/1/11 agreement included pre-construction and bidding services only.  The scope of this contract will include the replacement of the air side HVAC equipment and required electrical upgrades, light fixtures, ceilings, flooring, painting and the remodeling of the existing teacher planning areas into computer assessment labs.  This contract was negotiated on July 14, 2011, and the contract amount is $7,027,105.00.  This contract, which is the standard document utilized for all of the District's construction contracts, is available for review at the Construction Services Department.  The School Board attorney has approved the use of this GMP proposal acceptance form and contract.  Funds for this contract are available in the capital fund.

Recommendation
That the Guaranteed Maximum Price Proposal be accepted as presented and the Contract for Construction for Phase II of the Sarasota Middle School - HVAC Renovation project be approved as presented.

50. APPROVAL AND/OR RATIFICATION OF CONSTRUCTION SERVICES' CHANGE ORDER(S)
Description

The Construction Services' Change Order(s) are summarized on the enclosures for ease of review.  These change orders collectively total a decrease of $3,825,729.27 in gross contract dollars.

Included in these change orders are $3,825,729.27 credits for Direct Material Purchases; the corresponding Direct Material Purchase Orders of $3,608,283.21 result a net of $217,446.06 in sales tax savings.



Recommendation
That the Construction Services' Change Order(s) be approved and/or ratified as presented.

51. APPROVAL OF AN AGREEMENT AMONG ACHIEVA CREDIT UNION, THE SCHOOL BOARD OF SARASOTA COUNTY - PALS PARTNERS IN EDUCATION AND THE EDUCATION FOUNDATION OF SARASOTA COUNTY, INC.
Description
The agreement describes an arrangement among the School Board, the credit union and the Education Foundation in which the district will provide information about the credit union to staff in various print and electronic formats and post on the district website a credit union logo identifying Achieva as the sponsor of a new district online system to connect district business partner resources with needs identified in schools.  In exchange, the credit union will provide $30,000 over three years to develop, launch and maintain the system.

Recommendation
Recommend approval of agreement among Achieva Credit Union, the School Board of Sarasota County - Partners in Education and the Education Foundation of Sarasota County, Inc. for credit union promotional information and material.

52. APPROVAL OF ANNUAL RENEWAL OF THE AGREEMENT BETWEEN THE SCHOOL BOARD OF SARASOTA COUNTY AND SARASOTA COUNTY GOVERNMENT FOR HOSTING SERVICES SUPPORTING APPLICATIONS UTILIZED BY THE SCHOOL DISTRICT
Description

As a result of the ongoing collaboration between the Sarasota County Government and the Sarasota County School Board, the Hosting Services Agreement establishes a commitment for Information Technology Security and Support for all mission critical District applications, servers supporting those applications, and filtered internet access services for the school district.



Recommendation
That the renewal of the cooperative agreement between Sarasota County Government and the School Board of Sarasota County for Hosting Services supporting our applications, and filtered Internet access be approved.
